Terms & Conditions of use

1. Acceptance of Terms and Conditions
Your use of the MYOT.IE website indicates your acceptance of these Terms and Conditions. If you do not accept these Terms and Conditions, you may not use the MYOT.IE website. The use of MYOT.IE is a privilege. These Terms and Conditions are subject to change at any time by Vision Independent Productions (VIP) without notice to you. VIP reserves the right to suspend your use of MYOT.IE for any reason at any time, at its sole discretion.

2. Age Restriction
You must be aged 18 or over to use MYOT.IE

3. BMI  Restriction 
MYOT.ie is for use only by those with a BMI of 25 or higher. 

4. Medical Restriction 
You must have consulted with and taken advice from your GP before participating in or following the excercise and diet programmes available on MYOT.IE. 

5. Content & Function
MYOT.IE content and functionality, is provided on a "AS IS" and on an "AS AVAILABLE" basis without any representations or any kind of warranty whether express, implied or statutory of merchantability, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

6. Privacy Statement
All private data submitted by you to MYOT.IE is treated as confidential and will never be shared with a third party.

7. Disclaimer or Warranties
VIP or its agents does not warrant that the service provided as MYOT.IE will be uninterrupted or error free, that defects will be corrected, or that the MYOT.IE service will be avaialble after the March 7th 2013.

8. Limitation of Liability
VIP OR ITS AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM (A) THE USE OR THE INABILITY TO USE MYOT.IE  OR (B) RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF VIP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification
You agree to indemnify and hold each of VIP, it's agents and its officers and employees harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of the MYOT.IE website, the violation of these Terms and Conditions by you, or the infringement by you, of any intellectual property or other right of any person or entity.

10. Intellectual Property 
The text, graphics, designs, logos, button icons, images, video clips, data compilations and information ("Content") contained on MYOT.IE are owned or controlled by VIP or its respective owners and agents and are protected by international copyright laws. 

11. Third Party Websites
VIP does not endorse, and shall not be held responsible for any content, advertising, products, services or information on or available from third party sites. Third party sites linked through MYOT.IE are not covered by these terms and conditions.

12. Severability
If any provisions of these terms and conditions are found to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect.

13. Juristiction
These terms shall be governed by and interpreted in accordance with the laws of Ireland.
